t » rcHAn co v o WE HEREBY GIVE NOTICE, that by Deed of Assignment dated the Bth day of October. 1858, and made between Dauiel Munn, formerly of Wellington, in tht Province of Wellington, and Colony of New Zealand, but then of Napier, iv the District. of 'Ahuriri, in the same Province, Licensed Victualler, ; of the flrst^part, aud Jambs Meliss Stuart and John Gibson Kinross, both of Wellington aforesaid, merchant*, of tke second part, and the several other persons whose names and seals were thereunto subscribed aud set, being severally creditors of the said Daniel Munn of third part. After reciting a certain Deed 'Bearing date the said Bth day cf October, 1858, nud made between the said Daniel Munn of the one part, and the said James Meliss Stuart and John Gibson Kinross of the other part, being a Conveyance by the said Dauiel Munn to the said James Meliss Stuart aud John Gibson Kinross, their heirs, executors, administrators, and assigns, of &ll tho real 'and leasehold Instates of the said Daniel Muiiu. It was witnessed that for the considerations in the said Deed of As--Bij.'nnientmentioned, the said Daniel Mniin did thereby assign and set over unto the said James Melis3 Stuart and John Gibson Kinross, their executors, administrators, and ussigns, all and eveiy the Stock in Trade, Goods, Wares, and Merchandise, Household Furniture, Plate, linen, China, Books of Account, Book and othpr Debts, sum and sums of Money, and all Horses, Catile, Sheep, Carts, Drays, Whalcboats, nnd other Boats, and all other the personal Estate aud Effects vrhatdoever acd wheresoever, of him the said Dauiel Munn, in possession, reversion, expectancy, or otherwise, (except the wearing nppurel of the said Daniel Munn, and of his wife and children,) upon certain Trusts iv the said Deed mentioned, and amongst oilier Trusts, upon Trust that if the said Daniel Munn should not on the first day of October, 18.*>9, pay the several debts in tie said Deed of Assignment mentioned and thereby secured, that then the said James Meliss Stuart and John Gibson Kinross, aud the survivor of them, do and shall take possession of, call in, collect, anil receive, all and singular, the real and personal Estates of the said Daniel Munn, pud sell the same as iv the said Deed of Assignment mentioned. And we hereby Caution and warn all persons from dealing with the said Daniel Munn, in respect of any of the said Veal and personal Estates of the eaid Daniel Munn, so conveyed and assigned io us.
