It was witnessed that for the considerations iv the said Deed of Assi'inmeutmentioned, the said Daniel Munn did thereby assign nnd set over unto the said James Melisi Stuart and John Gibson Kinross, their exeeu'ors. administrators, and assigns, all and eveiy the Stock in Trade, Goods, Wares, and Merchandise, Household Furniture, Plate, lioen, Ch'na, Books of Account, Book aud oth-T Debts, sum and sums of Money, und all Horses, Catile, Sheep, Carts, Drays, Whaleboats, aud other Boats, and all other the personal Estate and Effects whatsoever atd wheresoever, of him the said Dauiel Munn, in pos» session reversion, expectancy, or otherwise, (except the weniing nnpurel of the Bnid Daniel Muun, and of hi 9. wife und children,) upon certain Trusts it the said Deed mentioned, and amount o;her Trusts, upon Trust that if the said Daniel Munn should not on the first day of October, 1850, pay the several debts in the said Deed of Assignment mentioned and thereby secured, that then tlie said James Meliss Smart and John Gibson Kinross, and the suivivor of them, do and shall take posse>siou of, call in, colleccj and receive, al> aud singular, the real and personal Estateß of the said Daniel Mu;m, t>nd sell the same as in the said Deed of Alignment mentioned.
