WE HEREBY GIVE NOTICE, that by Deed of Assignment dated the ftth day of October. I 18T>H,.and made between Daniel Aluidi. formerly of Wellington, in !he Province of Wellington, and Colony of New Zealand, but then of Napier, in the District of Ahuriri, in, the same Province, Licensed j Victualler, of the first part, aud James Meliss Stuart and .lolyi Gibson Kinross, both of Wellington aforesaid, inereliuntd, of the second part, and the severtl other persons whose names and seals were theieunto subscribe! and set, being severally creditors the s«id Daniel Munu of third part. After reciting a certnin Deed bearing date the s>aid Bth day of October, 1858, mid mrtdc between tho said Dariel Munu of the one part'and the said James .Meliss Stuart and John Gibson Kinross of the oiler part, being a Conveyance by the said Daniel Minn to the said James Meliss Stuart and John Gibson Kinross, their heirs, executors, administrators, and assigns, of kII the real and leasehold F'slales of the snid Daniel Munn. It was witnessed thnt for the considerations iv the said Deed of Assi.ciitncntmeniioneii,ilie Rtiid Daniel Munn did thereby assign and set overunto-the said James Melisi Stunrt nnd John Gibson Kinross, their exeuu'ors, adninistriifors, and assigns, all and evety the Stouk in Trade, Goods, Wares, and Merchandise, Househoid Furniture, Plate, I iuen, China, Books of Account, Hook aud other Debts, sum and .sums of Money, und all Horses, Cnt : .le, Sheep, Carts, Drays, Whaleboats, aud other Bonts, and, all other the personal ttstute and Effects whatsoever raidS wheresoever, of him the said Dauiel Munu, in possession, reversion, expectancy, or otherwise, (except the wearing- iippmel of the stiid Dtiuiel Munu, and of his wife taid children,) upon certain Trusts in the said Deed mentioned, and nmougst oilier Trusts, upon Trust that if the said Daniel Munn should not on the first day of October, 18.*>0, pay tie several debts in the said Deed of Assignment mentioned uud thereby secured, that iheu the said James Meliss Stuurt and John Gibson Kinross, and the survivor of them, do and sliall tnke possession 1 of, cr.ll in, collect, aud receive, all aud singular, the renl t.nd personal Estates of the said Daniel Munn, pnd fell the same ns in the snid Deed of Assignment mentioned. And we hereby caution aud warn all persons from dealing with the said Daniel Munu, in respect of any of the said real and personal Estates of the said Duniel Muuu, so conveyed and assigned to us.
