WE HEREBY GIVE NOTICE, that by Deed of Assignment dated the Bth day of October. 1858, atpd made .between Daniel Munn, formerly of Wellington, in iht Province of Wellington, and rGoloijy jS, Ne.TO Zealand, but then of Napier, in thp Dfatrictof Aliuriri, in the same Province, Licensed Victualler, of the first part, and James Meliss Stuart and .lolttj Gibson Kinross, both of Wellington fiforesftid, merchant*, of the second part, and Ihe several otlier persons whoso names and seals Were thereunto subscribe 1 and set, being severally creditors of the said Daniel Mium of third part. After reciting a certain Deed 'bearing date the said Bth dny of October, 1858, nnd made between the said Daniel Munn of the one part, ond the snid .Tamos Meliss Stuart and John Gibson Kinross of the other part, being a Conveyance by the said Daniel Munn lo the said James Meliss Stuart mid John Gibson Kinross, their heirs, executors, admiuistrntors, and assigns, of u\l the real and leasehold of the said Daniel Mnnn. It was witnessed that for the considerations in the said Deed of Assignment mentioned,. the snid Diiniel Muimdid thereby assign and set over unto the said James Melisi Stuart and John Gibson Kinross, their execuiors. administrators, and assigns, all and. eveiy the Stook in Trade, Goods, Wares, and Merchandise, ' Household Furniture, Plate, Linen, Cbinn, Books of Account, Book and other Debts, cum aii'l stuns of Money, and all Horses, Cattle; Rhenp, Curls, Drays, Whaleboats, and oilier Boats, and all other the personal Estate and Eftccis whatsoever at d wheresoever, of him the snid Duniel Mnnn, in possession, reversion, expectancy, or otherwise, (except the wearing nppnrol of the said. Daniel Mnnn, and of his vrifo nnd children,) upon termin Trusts in tho said Deed mentioned, and amongst other Trusts, upon Trust that if the said Daniel Munn should not on the first day of October, 3 859, pay the several debts in the snid Deed of Assignment mentioned and thereby secured, that then tlie said Janics Meliss Stuart and John Gibson Kinross, and the survivor of them, do and shall take possession of, call in, collect, and receive, al< and singular, tho real and personal Estates of the said Daniel Munn. piid sell the sani9 as in the said Deed of Assignment mentioned.
