ALLEGED ‘FALSIFICATION OF TRADEMARK. WELLINGTON, November -13. i In the Supreme Court, Daniel Moir is being charged with the falsification of a trad© mark, with intent to deceive and defraud the .original owners. The action was taken on, the information of Arthur C. Nottingham, New Zealand altorney for J aye-i Sanitary Company, and the indictment is that accused did falsely apply to ..goods a ocertain mark so nearly resembling , the registered trad© mark of Jeyes Sanitary Compound Company, of 64 Gann on Street, - London, manufacturing chemists, as to he calculated to deceive, with, intent'thereby to defraud the .said company. Mr* Macaseey»' appeared, for the Crown/, and Sir John Findlay and Mr L. Edwards for the accused, who pleaded riot guilty. The evidence for ’the prosecution was simiiar-.to that in the Lower Court. Sir John Findlay said - the whole question was one'of honesty. The evidence, would be that there was no technical infringement of the trad© mark, that the labels had come into the hands of the defendant from his predecessors, and that the defendant wae entirely ignorant of any infringement, and that he had . acted with an honest mind- The case is proceeding.
