AUCKLAND INNKEEPER'S CASE

MAGISTRATE'S CAUSTIC COMMENT.

AUCKLAND, March 31. Mr G. C. Kettle, S.M., gave judgment this morning in the case Police v. Flewellyn, the licensee of the Itoyal Hotel, who was charged with refusing accommodation to Homy Temple. The ease had occupied the Court for several days, and had excited much interest. Mr Kettle said that the evidence showed that the, licensee was sufficiently justified in refusing admittance to Temple. The latter admitted that he had nothing to complain of when he was staying at the hotel previously. When his remarks to the waiters about tho conduct of the hotel, and the food, and his remarks in the vestibule, when hjo 1 made himself a nuisance to the licensee and the people of the hotel, hud boon taken, into consideration, , his Worship considered that tho licensee was justified in refusing tho man admission again. .The .Magistrate characterised' Temple’s repetition in the bar of certain words, and applying them to the wife of the licensee, was a gross, gratuitous, and cowardly insult to the hostess and that if Plowcllyn had known of his conduct on that, occasion'.he would have boon .juati(icd : in ‘ taking Temple by the scruff of his neck and kicking him out of the hotel. Tho -Magistrate could not understand why the police had taken the case up. Sub-Inspector Hendry remarked that, it was probable that the matter would go further and ho heard in another place. His Worship said ,he would like it |o; do so, as it would bo interesting to hefar'a Judge’s remarks on Temple’s conduct.
