Mr Barnicoat, in opening the case I'or the plaintiff, mentioned that it was n friendly action between the two local bodies, and it had been arranged, no matter what the issue, that no order be made as to costs. The case had particulnr reference to the costs and expensea inoidont to the elections and meetings of the Patea Licensing COm- ! mittee, amounting to JB3S 13s lOd (from Ist May, 1900 to 30th April, 1001), which were in accordance with 'the provisions of. section 16 of the Alcoholic Liquors Sale Control Act Amendment Act, 1895, paid by the Patea County-Council. Portions of the license fees accruiv in the Patea Licensing District are received by all of the local authorities, except the Boad Boards, of which the Puma Road~ Board is one. The total licensr fees received by the local authorities in the said district is .£432, and the local authority in that district that receives the smallest portion of the license fees is the Waitotara County Council, which receives J620. The Patea County Council alleges that the Puma Boad District is liable to contribute fo the aforesaid costs and expenses, and that the proportion of Bitch costs and expenses payable b- the defendant (Puma Boad District is £\ Is 9d. For the defendant is was contended, that there was no liability. The Puruo BoaA District iB partly in the Pateo Licensing District. The defendant alleges that contribution to the expenses incident to the elections and meeting! of the Patea Licensing: Committee can only bo claimed by the plaintiff from the local bodies wholly or partly in the Patea Licensing- District, which receive or are entitled to receive licensing fees under the provisions of section 109 of the Licensing Act, 1881, and that the defendant not being such a local body is not liable to such contribution, an.l, further, that the contribution by the Wanganui County Council to, such expenses excludes all contributions from Road Districts within such County, and that the plaintiff is not entitled to claim a contribution from the Wanganui County, an<i.»V» a contribution from the Road Board within such County.
