AN IMPORTANT JUDGMENT.

INTERESTING TO C.TS. (Per United Press Association.) WELLINGTON, January 19. Judgment was given to-day in the case, Secretary of Btamps . Ryland and Son, incorporated, Great Britain, and Joseph Clark, Wellington, commercial traveller. Tho New Zealand manager of the hrm was charged with carrying on business, or business operations, in the colony without securing an annual license. In consequence tho department sued to recover three years' penalties, amounting to £720. The plaintiff contended that Ryland and Sons, by sending travellers to Now Zealand, were carrying on business here. Tor the defence, it was contended that the film did not carry on business in the colony. Clark only had authority to receive orders, winch might be lescfiided in London or Sydney, and he had no knowledge of the actual delivery oi goods ordeicd thiougli him. A largo number of _ authorities were quoted uy counsel on either side. Mr Haselden, S.M., said almost all the authorities cited wore in favour of holding tho defendants to carry on business or operations in New Zealand. Both defendants, therofole, would bo coiuicted, and fined .£720 and costs. Whether any reduction could bo made must be left to His E\eelleney's advisers, but he could say at once, that on one defendant paying tho lino ho should be prepared to recommend the remission of the penalty as against the other.
