THE KIRBY CASE.

(Po- United Press AaaociUon.) WBtLiKai'OH, October 22. In the Appual Court, the Crown case reserved, Eegina v. Kirby, was argnad The indictment oharged Eirby, in the first oounr, with accusing, and in the second connt with threatening to accuse Herman of having committed an infamous crime, and thereby extorting money. The evidence showed that Kirby informed Herman that he had a warrant aguinst him for an infamous crime, that Herman would get ten years for it, and the Government would take his property, but that Kirby would make it right if Herman gave him .£3OO. The juryfonnd that in fact there was no euch warrant in existence. The question reseryed was whether the above evidence showed an ccusation or threat to the accused by Kirby, the contention for prisoner being that there was no accusation or threat to accused by him, but ODly a ialse statement that some other person had made, and that this was not the offence charged. The question was also reserved as to the admißßibility of the copy of Kirby's Bank account, under the Bank and Bankers' Act, 1887, the contention for the prisoner being that there was no evidence of identity betfeen the prisoner and the person in whose name the account was kept. It appeared, however, that the items ot the acconnt were identical with the cheques shawn to have been drawn by the prisoner. The court unanimously ruled against counsel for prisoner on all points, and affirmed rha eonviotlon, Sir Bobert Stout and Mr Jellicoe were for the prisoner, and Mr Bell for the Crown.
