John Kennedy v. W m Kells. Claim £49 19s 9d. Tbe defendant paid into Court £-21 14s. Mr Keon appeared for plaintiff, and Mr Roberts for defendant.
The plaintiff's case was, that the defendant took oxer the account of one McClaren on the 27th October, amount-
ing to £H0 75.) McClaren deposed that the: defendant took over the account. The defendant's case was, that he agreed to take \ovei McClaren's account conditionally upon the plaintiff taking sheep for the amonnt at 3£d per lb. Judgment for £33 11s and costs. Ross and Anderson v. Wm. Loggie. Claim £10 7s. Judgment by default for amount and costs.
