BOLTON DIVORCE CASE

QUESTION OF COSTS, After the verdict had been, given in the Bolton v. Bolton and Hewitt divorce case at Palmerston North, Mr S. T. Tinuey asked for costs against corespondent (J. E. Hewitt). His Honour: “What have you to say to that, Mr Cooper?” Mr Cooper: “It is tho most extraordinary request I have ever heard. He asks for costs from a man against whom he had no evidence.” His Honour: “And who everyone in Court knows is guilty.” Mr Cooper: “The adultery of corespondent has not been established.” His Honour: “I would like to make him pay all the costs if I could.” Mr Cooper: “I am afraid there is no authority.” His Honour: “That is what I am afraid of myself.” His Honour then intimated that he would look into the matter, and if he could make co-respon-dent pay the whole of the costs he would do so. Meanwhile respondent would be granted costs against the petitioner.
