In the case Bank of Australasia and Oldham «. tho North German Insurance Company, the Appeal Court held that the truth of statements in the proposal had been established nnd (lie alleged misstatement hnd not been proved, The Court therefore gave judgment for tho plaintiff for £l5O with interest and costs on tho highest scale.
