Auckland, Thursday. , At the Magistrate's Court to-day j several cases for non-paymont of a c callMn the Bank of New Zealand came befoio Mr Northcroft, S.M. ] The first heard was Bank of New s Zealand v. William Basset Williams, j This was a claim to recover £sl and interest, being the third instalment £ of a call in respect of forty-five f shares held by defendant in the Bank of New Zealand, s The defendant appeared in person, j and, in answer to the Magistrate, said ho had had a paralytic stroke e and could not work. He had paid two calls—all he could. He had no ( means, and was soventy-four years i of age. He had saved up and invested in shares to mako provision i for his old age. 1 r -MrHanna, who appeared for the i ' Bank, said the directors wero com--1 palled to take proceedings against all f defaulting shareholders in justice to i 1 those who had paid up the call, It was not a case of persecution, i Mr Northcroft said that at one I timo it was looked upon as a fortunato thing to have shares in tho Bank ; of Now Zealand; now it was looked upon as unfortunate, He had no „ alternative but to give judgment for I 3 £53 lis 4d, with costs £5 Bs. ] ) In a second case against Mrs Made- i , line Gilmour, of Parnell, defendant i 3 did not appear. The plaintiff Bank i claimed £B3 6s Bd, being tho first 1 and second call and a third instal- i ment of a call in respect of ten i shares held by her in tho Bank, and 1 interest. Judgment was given for i £35 7s lOd, with costs £3 Is. In tho other cases judgment was confessed.
