BREMNER DISCHARGED

WAIMATE ASSAULT CASE. HELD TO BE A FAIR FIGHT. (From Our Own Correspondent). Timaru, this day. In the Supreme Court to-day, George Bremner came up for sentence on a charge of assault and causing actual bodily harm, arising from a street brawl in Waimate on October 3rd, when a man named Stewart, of Timaru, was injured. Mr A. C. Middleton, for the accused, pleaded that he had a good character and had given no previous trouble. Stewart had accosted accused, bringing his trouble on himself. There was a perfectly fair fight, which, but for an unfortunate accident, would have resulted in a fine or admonishment. Counsel called G. Joyce and S. Malthus, who gave evidence as to accused’s good character. Mr Justice Adams said that under the circumstances a jury might not have convicted. A severe penalty was not necessary; the blow appeared to have been a fair blow., struck in a perfectly fair fight. It was not a case for probation, as continuous supervision was not needed. Accused was ordered to pay the prosecution costs, £5 8s Bd.
