DANCING ON SUNDAYS
POLICE CASE FAILS (PA) Auckland, April 21. A ruling of interest to dance ball and cabaret promoters was given in a "reserved decision of Mr. P. H. Levien, S.M., recently, concerning charges against Civic Theatre Ltd. of keeping the Civic winter gardens cabaret open on a Sunday for transacting business, and against’ the manager of Hie Civic cabaret. Hector Colin Olsenl of working at his calling in view of a public place on a Sunday. The prosecution admitted that the Auckland City Council gave the company authority to continue dancing till 1 a.m. on Sundays, provided nobody was admitted after 11.45 p.m. on Saturdays, but the police held that the council had no right to over-ride the statute law by giving permission to open after midnight. Dismissing the informalions, the magistrate said he could not find any thing to support a contention that when a dance was going" on and nobodv was getting in. that a place should be deemed open.
