Auckland, Nov. 14 The opinion that there were questions fit to be sent to the Court of Appeal was delivered by Mr. Justice Callan, after hearing argument on questions of law rising out of the case of Maxwell Stuart Walker, aged 41, a former solicitor, who was found guilty of failing to account for trust moneys from deceased estates. A motion for an order reserving questions of law for the Court of Appeal was opposed the Crown Solicitor. In his minute His Honour stated he had avoided forming any definite opinion in order to leave himself free to sit. It was usual for the Judge who stated the case to sit if he happened to be a member of the Division which heard the case. It was often an advantage that he should sit. If counsel would draft the case it would be considered. His Honour suggested that five questions of law arose, and he listed them for counsel’s consideration in drawing up the case. It was stated that an application for release of the accused on bail would be entertained.
