OIL ON HARBOUR

£2OO FINE ON U.S. MASTER (P.A.) Auckland, Nov. 12. A sequel to the discovery in the harbour at the week-end, of large patches of heavy oil, which caused considerable annoyance to yachtsmen, was the appearance before Mr. J. Luxford, S.M., of Edward B. Clayton, master of the United States War Shipping Administration’s vessel, Jonathan P. Dolliver, charged with allowing oil to escape from the ship. The prosecution was laid by the Auckland Harbour Board under the Oil in Territorial Waters Act, 1926.

Evidence was given by the harbourmaster, Captain Sergeant, that according to a rough estimate 1000 gallons of oil were released in lhe harbour. He considered the pollution was due to gross carelessness. In imposing a fine of £2OO and ordering defendant to pay for the cost of removing the oil, the magistrate said the Act had been in forte for nearly 20 years and it was essential that its provisions be strictly complied with. It appeared in this case that the release of the oil was due to very gross negligence indeed.
