ONEKAKA RIGHTS CASE

APPEAL COURT DECIDES AGAINST CROWN (P.A.) Wellington, Sept. 30. Decision was given by the Court of Appeal yesterday in the Onekaka mining case, the Court finding unanimously against the Crown. ..The case originated in the Crown’s seeking the forfeiture of mining privileges at Onekaka, but the warden found that breach of contract by the Crown disentitled it to seek forfeiture. The Crown appealed to tne Supreme Court, and the Chief Justice (Sir Michael Myers) dismissed the appeal. Yesterday the Court of Appeal dismissed an appeal from the Chief Justice’s decision. The judgment of the Court, which consisted of Mr. Justice Blair, Mr. Justice Kennedy and Mr. Justice Callan was delivered by Mr. Justice Callan. At the hearing, which occupied 16 days in July, August and September, the Solicitor-General, Mr. H. H. Cornish, K.C., and Mr. C. A. I. Treadwell appeared for the Crown, Mr. P. B.
