MAGISTRATE’S COURT

SITTING AT WANGANUI The Magistrate’s Court sat at Wan* ganui yesterday, Mr. J. H. Salmon, S.M., presiding. The police were represented by Senior-Sergeant L. R. Capp and Detective-Sergeant J. K. Robertson. Horace Enfield pleaded guilty to a charge of rescuing cattle which had been impounded. Mr. C. F. Treadwell, who appeared for the City Council, said that on October 28, 1936, Mr. Minnell, city inspector, found cattle wandering in College Street, and had them impounded in a paddock between eight and nine at night. In the morning it was discovered that the cattle had been removed and the gate had been taken off a hinge to let them out. The prosecution was taken as a warning. Counsel had been informed that on other occasions cattle had been taken from paddocks where they had been impounded. The nearest pound to Wanganui was at London Street. Defendant said that what he did was done quite openly. They were milk cows and were so well known that he thought what he was doing was quite right. He had fully intended to inform the authorities as to his action. Imposing a fine of £3 (costs, 10s; solicitor’s fee £1 Is) His Worship said that it was a serious matter to rescue cattle which had been impounded. The prosecution asked for a penalty as a warning, but His Worship was of opinion that it was a case in which he should impose more than a nominal penalty.
