WAVERLEY

MAGISTRATE'S COURT. A sitting of the Magistrate’s Court was held in Waverley on Wednesday, - Mr. J. 11. Salmon, S.M., presiding. < Informations were laid by Mr. E. • Wilson, highways inspector, against E. ' J. Gill and Co, Wanganui (2 charges), R. S. How, of Waverley, and K. G. 1 Rountree, of Wanganui, for carrying ( loads greater than provided by the road classification on the Waitotara : Valley Road. Mr. G. H. Graham, counsel for R. S. How, pointed out that in each instance the charges were for carting lambs for at least two seasons and no objection had been taken, but in January of this year the Waitotara County Council had decided to take action. If the regulations were enforced such action would be serious for the farmers in the upper Waitotara district. The Upper Waitotara Road was under the jurisdiction or both the Palea County Council and the Waitotara County Council. The I’atea County Council had taken no 1 action but unfortunately the Waitotara County Council controlled the lower length and the lorries had to pass over this length to get jut. It was pointed out that representations had been made by .the respective counties to lift the restrictions but so far nothing had been done. Counsol also pointed out that the Government had inLmated its intention of reviewing tho position of the regulations and to bring them into conformity with the condition of the modern motor vehicles. The magistrate said that so long as the regulations were in force his duty was to enforce them. He was not prepared to dismiss the informations and entered a conviction in each case, with payment of costs only. A fine of £2 and costs was entered against W. R. Orr for speeding. The highway inspector said that the speed s of the lorry was about 40 miles an hour, while under the classification- the regulation speed was 20 miles an hour. On a similar charge H. Dyer was fined £3 and costs. The alleged spe?jd ; was 45 to 50 miles an hour, when the , regulation speed was 20 miles an hour.
