Their judgment is: “We have careful! v considered Atkins’ appeal and we are satisfied that, although Atkins was nor present during trie whole time the evidence was being taken bv the judicial committee of the Wellington Racing Club during its in - vestigations into the cause of Gay • "nief falling in the Pacific Handicap, run on the fourteenth day of March,! r.C.G, he was not prejudiced thereby, as in his appeal before the Wellington District Committee he had every opportunity, of which he availed himself, .»f hearing aH the evidence and questioning all the witnesses and bringing further evidence.
