The sum of £l5 had been paid. Air. Beecrott, for Elkingtons, said the onus was on him to- prove that the articles were necessaries having" regard to Mr. Amery's station in. life. Judge bir Allred Tobin: What dues the young man want with a vanity case Air. Deeeroft: Apparently for the young lady to whom he was then engaged. The diamond ring was also for her. The Judge: 'Where are the articles now ? Air. Beccroft; 1 think they are in his possession, lor she is his'wife. Mr. Freschiield (for Air. Amery): .1 am instructed they were not for his wife. Mr. Beccroft said that in 1931 Air. Amery bought jewellery at Elkingtons to the extent of £IUU, for which he paid cash. The assistants thought they were dealing with an affluent person. They knew' he was living with iiis father, at that time a Cabinet Alinister. The salesmen had no suspicion 1 that Air. Amery was under age. The Judge: Am I to understand that Ire has kept these other goods? Air. Freschiield: He has not kept them, and it is lather difficult, when you have given things to a young lady, to say that you want them back. Later Air. Freschiield said he was prepared to admit the father was very well off. but he was not prepared to admit lhat the things were necessaries. Adjourning the hearing, the Judge said: ”1 suppose I sihall not hear any more of this case.” Mr. Beecroft: Your Honour would not be worried by me if we could get a reasonable proposition. Mr. Freschfieid: I am afraid that defendant is in a bad financial ijosition and docs not like to make definite pro- ! misos.
