TRANSPORT AUTHORITY
IMPORTANT LEGAL POINT. [ Per Press Association I IDUNEDIN, Feb. 2. A decision of importance concerning rights of the city authorities to engage in transport outside their own districts was given by Mr. Justice Kennedy at. the Supreme Court this morning in a case in which a writ of certiorari was sought against No. 9 Transport Authority in granting a seasonal licence to the Dunedin City Council to operate a bus service io Eglinton Valley. The .Fudge found that the corporation had no authority to operate a service taking passengers as far away as the lake country was. The decision of the Licensing Authority was set. aside. The Judge's ruling was based on section 217 of the Municipal Corporations Act., which provides for the establishment of services with the consent of the “neighbouring local authority,” His Honour holding that the lake country was beyond question not a neighbouring local authority.
