UNDEFENDED ACTIONS WANGANUI SUPREME COURT. Undefended divorce cases were dealt with by Mr Justice Blair in the Supreme Court at Wanganui yesterday. Edith Mary Sophia Jenkins (Mr Brodie), petitioner, said that she had been married to Henry Charles Jenkins, -i storekeeper, on November 20, 1901. After the marriage she had lived with her husband at Kimbolton. There had been six children. She obtained a separation order from a magistrate under the Destitute Persons Act on November 29, 1926, on the grounds of her husband having failed to maintain her. She had lived apart from her husband since 1926. Alice Hurley, a daughter of the petitioner, said that her mother’s evidence was correct. Mr Justice Blair returned a decre nisi with the custody of the children, to be made absolute after the expiration of three months. Costs were given against the respondent.

A decree nisi, to be moved absolute after three months, was granted Oscar Everell Burden (Mr Tustin). In evidence, petitioner said that he had married Charlotte Burden in 1905 and they had lived together until February 11, 1927, when they had entered into a deed of separation. He had not lived with his wife since then. Maintainance had been paid regularly. His wife was now resident in Nelson. Charles Moutray corroborated the petitioner’s evidence as to no co-habitation since the separation.

Stewart McDonald (Mr North) petitioned for restitution of conjugal rights, the respondent being Ruby Catherine McDonald. Petitioner said his wife left him in November, 1920, and refused to come back. The decree asked for was granted, the period being 21 days.

Eileen N. Voice (Mr. C. F. Treadwell) petitioned for divorce from Charles Wm. Voice. Petitioner was married in October, 1923. There were two children. In March, 1928, she obtained a separation at Marton. A decree nisi was granted with custody of the children, to be moved absolute’ in three months.

Walter .Tames McKean (Mr Currie) petitioned for dissolution of marriage from Lilly Mary McKean. L. A. Noilson was joined as co-respondent. The parties were married in April, 1928 nt Patea. In January last petitioner had to enter a hospital. When he returned home he found the place locked. On gaining entrance he found the interior in a rough state, and beer bottles and cigarette butts lying around. He went to Ohakune and saw his wife, who refused to come back. A decree nisi was granted to be made absolute after three months.

Jack Cooper (Mr Haggitt) petitioned for divorce from Florence Jane Cooper. The parties were married in February, 1927. There were no children. In October, 1930, they agreed to separate. In July, 1931, he found that his wife was living with Jack Morton, who was joined as co-respondent. A decree nisi, to be moved absolute in three months, was granted. Maude Jane Thornton (Mr Bartoni, petitioned for dissolution of marriage from Hillary Jack Thornton. Petitioner was married in June, 1915. There was one child. In April, 1928, the parties agreed to seperate. Witness then came to Wanganui from Nelson. A decree nisi was granted to be moved absolute in three months.

Walter Isaac Down (Mr Cohen) petitioned for divorce from Dolly H. Downs. Leonard Green was joined as co-respondent. Petitioner was married at Rata in April, 1911. The co-respond-ent was also married and was his wife’s uncle, and lived at Rata. He was a constant visitor to petitioner’s home. Tn May last, when petitioner was at the Wanganui races his wife cleared out with Green, and had only been back once to see the baby. A decree nisi wps granted with custody of the children, to be moved absolute after three months; costs on the lowest scale against, co-respondent.
