DRIVER FINED COLLISION WITH CAR Shortly after sunset on Monday evening a motor-car collided with an unlighted horse and cart on No. 3 Line. No one was hurt, but the upshot of the incident was that the driver of the. horse and cart, appeared before Mr J. H. Salmon, S.M., at the Magistrate's Court yesterday. He was charged with' being found drunk while in charge of the horse and cart and with driving in a negligent manner. Defendant pleaded guilty on both charges. Senior-Sergeant McLean stated that the defendant was a dairyman. He came into Wanganui on Monday and transacted some business, at the samo time partaking of a quantity of liquor. He left about 5 p.m. to drive to his home at Wanga'ehu. As a result of the drink he went to sleep on the *nd. The motor-car coming in from Marton collided with him. The defendant was brought in to the Central Police Station, and two hours later, he had no recollection of getting therjg, so there was no question as to his drunkenness. He stated that he was up at 4 o’clock in the morning and possibly want of sleep and the quantity of liquor consumed wrs the cause of his dozing off. While the offence of being drunk in charge of a horse and cart was not so serious as being in charge of a motorcar, said the magistrate, the case nevertheless was serious. The defendant would be fined £lO on the charge of negligent driving and convicted and ordered to pay 30s costs on the second charge.
