FURTHER LITIGATION MOVE TO DEFEAT RECENT SALE. [Per Press Association.] CHRISTCHURCH, May 20. The Morgan v. Wright case developed a fresh phase to-day, when Mr Justice Adams heard an application for an order removing a caveat from the Registrar of District Lands. Caveat was lodged by Lilian Kate Nosworthy (wife of the Hon. AV. Nosworthy) and Eva Ethel Roberts (wife of C. C. Roberts), formerly of Ashburton, but now of Dorset, England. The caveators are daughters of Mr C. E. G. Wright, a former member of Parliament, who died many years ago, leaving his estates, Surrey Hills and Windermere, in the Ashburton County, to members of his family. The Surrey Hills estate was advertised for sale in Christchurch on April 22 by order of the Registrar of the Supreme Court, at the request of the Bank of New Zealand, as mortgagee, D. G. Wright having given mortgages over the land to the Bank.

The caveat against the transfer of the titles to the land was lodged some days before the sale. The caveators claim that the land offered for sale came under the Privy Council’s judgment, and that it is now subject to trusts of E. G. Wright’s will, under which they claim an interest in the estate as beneficiaries. The sale was gone on with, and several blocks of land were sold. The bank now asks that the caveat preventing the transfer of titles to the purchasers be removed.

Sir John Findlay, with him Mr Wright, appeared for the bank as plaintiff in support of the application. Mr Andrews, for Mrs Nosworthy, and Mr Upham, for Mrs Roberts, opposed the application.
