ACTION AGAINST LEGAL FIRM.

Allegations of negligence and a breach of duty are the basis of a civil action which was under review by Mr. Justice Salmond at the Supreme Court. The plaintiff (J. A. Chesham, a farmer) is seeking to recover £2258 13s 8d from a firm of Wairarapa solicitiors, Herbert Hart and Allen Hogg, the claim being for alleged negligence in investing moneys on behalf of the plaintiff. For the defence it was maintained that any proposed investments had to be, and in fact were, submitted to plaintiff for consideration and approval and the latter had exercised Ins own discretion and judgment. A-1 reasonable care had been taken by defendants with reference to the investments.
Mr. Justice Salmond gave oral judgment for defendants, remarking that he was unable to rely on the evidence of plaintiff, who has a
bad memory. Defendants could not be legally liable.
