At the hearing of General Dyer's action against Sir Sankara Nair, Mr. Laniel, counsel for the defence, raised the issue as to the propriety of General Dwyer’s action, Mr Justice McCardie asked: “If what Dwyer did was necessary for the prevention of anarchy can it be said to be wrong?” and added: “If five hundred were killed half a million were saved. The police had completely lost control. You seem to be ignoring the grave consequences that might have followed if Dwyer’s force had been destroyed.” Later, Mr. McCardie interposed that he could not see the distinction in principle between a policeman’s bludgeou and a soldier’s rifle or an aviator’s bomb in suppressing a rebellion. The hearing was adjourned.
