CLAIM FOR A DOG
On Tuesday, Mr Wyvern Wilson, S.M.. heard a. case in which Jas. Wilson (Mr Mackay) sued John Cullinane (Mr Slipper) for £10 for a dog belong-, ing to th c plaintiff, and killed by defendant's car opposite the Aramoho Post Office. Plaintiff and his wife alleged that defendant was travelling at forty miles per hour. Under cross-examinn-.. tion the plaintiff estimated that 'he local tramcar.« when travelling fast i^o abour five miles per hour. His Worship figured if-, out that at- thi> rate Cullinane irm-.t havo been travelling about 120 miles per hour ! Defendant stated thal" he was travelling at Jilxwt, 18 miVss per hour, in a small car. that the dog suddenly ran across his path, and thrtt he swerved to avoid an accident, but unfortunately .struck the dog with one wheel. His Worship came to the conclusion that there was no satisfactory evidence to prove excessive speed on the part of the defendant, and nonsuited plaintiff, with £1 Is. costs to defendant.
