Sf t. oul tllat defendant empu»ed tifc plaintiff to-secure a lease ot certain property i v the Avenue, and it was alleged the defendant had agreed Uat in consideration of the completion ot the lease by plaintiff, the defendant would grant to the plaintiff a sub-lease o, certain rooms, being part of the building to be erected by defendant. Upon completion of the building the defendant gave and the plaintiff took possession of the rooms. Plaintiff subsequently tendered to the defendant ? draft lease, but defendant refused to sign the same. Later defendant issued <L sum™ons for possession of the rooms. Jlamtift asked for a proper lease of the rooms. .
