ON APPEAL.
HAVES v. BOURKE,
This was an appeal on fact and law by John Hayes, of Auckland, against the decision of Mr W. Kerr, S.M. , -that a game p'ayod with a marked glasstopped cabinet and rings was a gamo of chance.
Mr W. J. Treadwell appeared for appellant, and Mr C. C. Hutvon for respondent.
Evidence was given as in the lower Court, with 'the addition that Sergfc. Bourke and Constables Wilson and Connor gave evidence hat they had practised 'the alleged -game, arid had i,ot been able to become' skilful :;t it, and that they considered success at it a matter of chance.
On the Court resuming the evidence of John Hayes, the appellant, was taken.
Counsel then addressed the Court at length, after which His Honour referved judgment.
