,- NELSON, September 20. In the Stoke charges, in opening the casp for the prosecution, Mr Myers said informations had been laid under the Criminal Code Act because the time limit of . three months imposed by the Indictable Offences Summary Jurisdiction Act, 194, has expired, and it was necessary that the cases should go to a jury. Reviewing the charges, Mr Myers enumerated them, and said that among the hoys alleged to have been assaulted by. ( Wybertus, one was. silly, and other a coil- ! sumptive. As to the charge of indecent assault details were revolting, and he would; * not go into them a;t the present stage of the proceedings. He then proceeded to call evidence, . • ' John Lane, aged 15, at prese'nt at Burnham Industrial School, said he was going to breakfast with some boys before and , some behind him, .when Wybertus kicked him, and smashed his hand. Witness fell, and hit his head against the edge of a door. He was greatly hurt, and bled much. - He was taken to Dr Duff, and his head " was bandaged for a week. He was kickedbecause he had not his braces on, and was' holding up his trousers. ' j Corroborative evidence (was given by" other boys. . . The cases are likely to last a fortnight.. -
