A TOTALISATOR CASE.
(PER UNITED PREBS ASSOCIATION.) Wellington, Feb. la. At the Magistrate's Court this after' noon Daniel Dark brought an action against the Island Bay Racing Olub for £2 6s, being the amount which he alleges Bhould have been paid to him as a dividend on the horse Talebearer in th* Oonsolation race at the Island Bay meeting on the 23rd January. The race first resulted in a dead heat between Talebearer and Little Scrub, but in the run off Little Scrub won, and the stewards authorised the totalisvors t'j pay out on that horee. The plaintiff contends that the money in the michine ah ->vld have been divided. After a long argument his Worship held that investments in totalisators were nothing more than bets on racing, and therefore oould not be recovered, He gave judgment for the defendants with £9 costs. Notioe of appeal was given.
