(OWN CORRESPONDENT.) Yesteiday The races took a lot of people to Hastings to-day, and the town was practically deserted. Judgement was given to day by the Chief Justice fn tho appeal case of Baxter v Constable Harvey. Appellant was convicted by the Resident Magistrate for having in his possession flounders less than nine inches Jong. His solicitor, Mr P S McLean, appealed against tbo con viction on the. ground that the fish were caught outside the three-mile limit, nn<i therefore did not c ome within tho defini tion of “fish inhabiting New Zealand waters. Ilis Honor uphe'd this contention aDd all wed the appeal, with £7 7s costs Tho Chief Justice also gave judgemen.
-k to-day in the case of Herman v Joyce h tho decision being for the defendant ig on the ground chiefly that the license was endorsed after tho contract to buy His Honor hold that there had beer a contract to purchase, aud declined tc allow costs to the defendant on the ground that part of his evideuqo appeared 1 to have been intentionally untruthful. 9 Throe youths were to-day fined by the Resident Magistrate’s Court—Messrs Sutton and Vauti<r officiating—foi 6 fishing ou the Petune bridgo. This st practice is dangerous to riders of borsef h, and drivers of vehicles.
