Resident Magistrate’s Court.

Waipaxva, Tuesday, July 27. (Before Samuel Johnson, and A. St. C. Inglis, E »qrs. J. Pb-V Joseph Fletcher was charged by the police with unlawfully wounding five pigs the property of John Peers. Sergeant Ityan conducted the prosecution, and Mr Loughnan appeared for the accused who pleaded not guilty. The evidence in this case was identical with that published in our report of the former case heard last Friday, with the exception of some additional evidence which introduces rather rough language, which would not grace our columns nor do any good to the parties concerned by the publishing of it. The bench gave judgment as follows, “ They considered that a prima facie case had not been made out. The accused under the orders of his father was carrying out liis understood right to destroy the pigs on his fenced land. The evidence of actual malice was not supported and they preferred to give accused the benefit of the doubt and dismiss the information.
