NOTICES. “TN the matter of “the -L TRAMWAYS ACT, 1908,” AND ITS AMENDMENTS. NOTICE IS HEREBY GIVEN that the Raglan County Council and the Ngaruawahia Town Board (hereinafter referred to as “the Li cil Authorities”) intend to apply for an authorising order under the provisions of “The Tramways Act, 1908,” and its amendment unless forbidden by the ratopajers in terms of the said Act authorising the construction of a tramway from Te Akatea to the Waipa river along or adjacent to the road from To Akatea to Ngaruawahia in the County of Raglan and from the Waipa river to the Government Railway Station Reserve in the Town of Ngaruawahia. Plans and cross and longitudinal sections of the proposed tramway together with a draft of the Order-in-Council proposed to be submitted to the Governor for approval are deposited for public inspection at the offices of the Local Authorities at Ngaruawahia in accordance with the above-mentioned Acts.

AND NOTICE IS ALSO HEREBY GIVEN that in the event of such authorising order being issued it is the intention of the Local Authorities on the issue of the same unless forbidden as aforesaid to delegate the authority so conferred on the Local Authorities to the Waipa Railway and Collieries, Limited, upon the terms and conditions following:— )1. TERM: Twenty-one years from ' the date of the authorising ordoi with a right of renewal for s further twenty-one years if the Local Authorities do not exercise the option of purchase given to them at the end of the first term. RENT: Five pounds per annum to each Local Authority during the first twenty-one years and during the second term if granted as agreed upon or settled by arbitration. TIME FOR CONSTRUCTION: The Tramway to be commenced within twelve calendar months and to be completed within thirty-six calendar months from the date of the authorising order. RIGHT OF PURCHASE: The Local Authoiities are to have the right of purchasing the undertaking at the expiration of twenty-one years at a price to be determined by arbitration without anv allowance for goodwill and are to have the same right of purchase at the end of the second term of twenty-one years if granted, and if they do not then exercise such right the Local Authorities arc to offer the tramway and under taking for lease for a further term of twenty-one years by public auction or public tender. In the event of the Local Authorities purchasing the un dertaking at the expiration of the said first term of twenty-one years or of any person other than the Company obtaining a lease the Local Authorities or such lessee are to carry the coal and other products and inward goods of the Company for twopence per ton per mile. GENERAL TERMS AND CONDITIONS. The Company is to provide and maintain sufficient plant for the running of the tramway and to run at least one train a day each way except on Sundays and certain holidays or when the mine is prevented from being worked. The tramway is to be available at all times for the carriage of passengers and cargo at rates not exceeding those charged on the Waikato section of the Government railways. Stopping places are to be provided, yards and sheds are to be erected, the j timetable is to be approved by the Local Authorities and provision is to be made for the fencing of the line the forming of the roads along which it runs and the conduct of the undertaking in such a manner as not to cause a nuisance to the public and such other provisions us the Local Authorities think necessary to protect the interests of themselves and the inhabitants of their respective districts.
