THE TOLOSA AFFRAY.

(BY TELEGRAPH—PRESS ASSOCIATION). Wellington, Last Night. Hatz itkis, the Greeii boatswain of the Tolosa, was before the Court again today on a charge of stabbing three firemen.

The medical evidenco went to show that ttee wouads were in an upward direction. Saunders had quite recovered and Newbury's condition was good. Jones was still in some danger, but he was a bad patient and would not obey orders, which had not improved his condition. Newbury had two small abrasions on the cheek which looked as if they might have been caused by a bite. Roberts, a fireman, deposed that he saw accused on top of Newbury at the beginning of the affray, and the latter shouted out he had been bitten. Afterwards he saw them fighting again, aud accused, who had a knife in his hand, made two or three digs at Newbury, who cried out " I am stabbed." In the course of cross-ex-amination, witness said he was sure Newbury struck accused several times before a knife was used. He supposed accused jumped overboard because of the threats made against him. Jas. Sanders, one of the men wounded, gave evidence that he saw the Greek with a mark above his eye, and asked him what was the matter. The Greek lifted a hammer, as if to hit somebody. Witness and some other man caught hold of the haft of the hammer. Hatiitkis let go and then witness felt the stab. When the blow was struck other men came up and accused then attacked Jones. Then he afterwards went towards the forepart of the ship and witness then saw him sticking the knife into Newbury. Witness went below after he had been stabbed and got his sheath knife, but he did not use it, as the accused had just gone overboard. Cross-examined, witness said accused stabbed Jones and Newbury before either of them could Citeh hold of him. He heard no cries about throwing him overboard. At 5 20 p.m. accused was remanded for a week, bail being allowed in two sureties of £l5O each.

An information was sworn against Thos Grant this afternoon, charging him with having assaulted Hatzatkis. Similar charges have already been laid against the three wounded men. Thos Grant one of the firemen con-

cerned in the Tolosa row pleaded guilty to a charge of assaulting the gincer. He said he struck the cause he expected the latter was going to strike him. He was remanded for sentence until after the Greek Hatzatkis is dealt with.
