DEATH OF A CHILD.
CHARGE AGAINST TRUCK DRIVER. MAGISTRATE SENDS CASE TO JURY. NEW PLYMOUTH, July 30. Contending that there was not a prima facie case to answer and that no jury would convict on the evidence, counsel to-day unsuccessfully asked for the dismissal of a charge of negligent driving causing death against Ernest Edward Baker, aged 19. The proceedings were heard in conjunction with an inquest on June Vivian, aged eight, who was killed last Friday morning when she was knocked down by a motor truck being backed across an intersection by Baker. Several children were standing on the corner waiting for a tram car. Two were knocked down, a wheel passing over June Vivian, who died shortly afterwards. “This case will have to go to a jury," said Mr. W. H. Woodward S.M. “If this girl had been an adult, or had she been in the company of an adult, I should have had no hesitation in dismissing the case but where children are concerned a high degree of care is needed and I am not prepared to take the responsibility of dismissing the case before it goes to a jury. I do not want to say any more at present." ~(P.A.)
