BREACHES OF BAKERS' AWARD

LOCAL RAKERS FINED.

At the Magistrate's Court, Lawrence, yesterday ('before J. It. Bartholomew, Esq., S.M.J Inspector Hollows sued Frederick Martin and Ch|as( Swaowiok for £lO as penalty for a breach of the Dunedin Bakers' and Pastrycooks' Award, dated 28th September, 1907, i.e., for employing their carters, Mliurice Wialker end William Brftwto fin thjefc bakehotoes) m connection with the manufacture of goods in the baking ; trade contrary to clause 24 of the said award.

Inspector Hollows appeared for the Department of Labour and Mr Fletcher ' for Mr Martin. Mr Swanwick was unrepresented. Both defendants pleaded guilty to a technical breach and Mr Fletcher pointed out that his client was under the impression that country bakers outside a ten-mile radius were exempt from' the tenim of the award in regard to. employing . their carters in their bakehouse. Mr Swatiwick in his own defence said that' beyond boing cited he had no knowledge that he was even a party to the award and had never Been a copy ot it. until ho got the summons. He pointed out further that the statement by the Inspector as to the hours worked by tha lad on his cart was greatly exaggerated, the facts being that the work in lha bakehouse totalled 34 hours and the outside work about four hours. If the latter 'took longer it was Uv lad's own fault.

His Worship held that more than a technical O ffenco had l)een committed ; that it was the duty of those eii'jttired in an industry to 'acquaint I hemselves with the award under which they worked, and imposed a line of £3 in each case. .There were no oonts.
