An interesting legal point was decided at the Magistrate's Court, Christchurch, on Monday morning, in connection with a .judgment summons case. A Christchurch firm obtained judgment far a sum of some to some time ago against one of its, debtors. Subsoqcntly the judgment debtor became 'bankrupt. The judgment creditors attended a t •-"<-' meeting of creditors, at which an assignment was mtdu of debtor's property. On Monday ujorning they proceeded against the debtor by means of a judgment summons for the full amount of the debt, but defendant claimed, through his solicitor, that lie was not liable for tho full amount, since the creditor had been present at tho meeting of his creditors, and had acquiesced in an nrrangoiuent by which the debtor was to pay a certain sum in tho £. Counsel for the creditor submitted that, though present at the meeting, the creditor concerned had taken no part in the meeting, and had not adqtuiesced in the assignment. It was decided, in view of this that the creditor was not Wound by the assignment, a nd that tho full debt must now be paid.
