RESIDENT MAGISTRATE'S COURT, LAWRENCE.
At Ihe above Court, on Monday last, before J. N. Wood, E?q., R.M., the following business was transacted :—: — Tnistees in i?. Grieves Estate v. Denis Casey.— Claim of £4 10s. Mr M'Coy for plaintiff. Verdict for amount, with costs (225). F. Oudaille v. A. Forrest.~Mv Copland, for plaintiff, made application for a judgment summons. Time extended til 2nd March. Same v. Alex. Spai-lcs. —Application for a judgment summons. Mr Copland for plaintiff; Mr Crooke for defendant. Mr Copland examined defendant at great length with the object of ascertaining what position Sparks was in since judgment hud been obtained a gainst him for £47 4s Id in September last. It transpired that defendant was the owner of a deferred -payment seel ion in Table Hill district, which had been capitalised at £179 18", and that he had tiied to sell the land, but could not finrl a purch ser.— Mr Oudaille deposed that the bulk of the amount sued for was for fencing material, and tbat he had supplied defendant wilh bags, which were to be relumed filled with grain in payment of his account, but defendant had not fulfilled his promise, inasmuch as he forwarded and disposed of the grain and bags in Dunedin. All the plaintiff sought was some security for his account.— Mr Crooke contended that defendant was not in a position since judgment was obtained against him to pay the account.— His Worship remarked that the case was i.ot proved that defendant was in a position to pay since the judgment had been obtained against him, and dismissed the CRse without cost?, remarking that Mr Oudaille's course was to go to the Supreme Court, and force the sale o? the land. This was all the business before the Court.
