Wife Would Not Live With Husband. PETITION TO COURT. “ Petitioner is entitled to an order, but this sort of thing should not be encouraged,” said Mr Justice Northcroft this morning, when Frederick Fisher Van der Veen, of Christchurch, shop assistant (Mr Sargent) petitioned for an order for restitution of conjugal rights against Enid Van der Veen, of Sheffield. “ This was a secret marriage,” said Mr Sargent, “ and after a few days the lady tired of it, and now refuses petitioner’s request that she should come, back to him.” Petitioner said that they* were married at Timaru on May 21, 1934. They went to Timaru, as the wife did not want her parents and friends to know of the marriage. She continued working. It was in September that she left him, giving no reason. They had never established a home, but \vitness was willing and able to do .so. The wife had refused written offers to that effect. “ It is not a very satisfactory case,” said his Honor. “It looks as though the marriage has never been a real Mr Sargent: If the wife obeys the order, no one will be more pleased than petitioner. “ I am glad to have that assurance,” said the Judge, in granting the petition.
