PUBLIC NOTICE OF INJUNCTION GRANTED BY THE SUPREME COURT AT CHRISTCHURCH. P ENFOLDS WINES, LIMITED, of Sydney, obtained in the Supreme Court at Christchurch on the 23rd November last an injunction and other orders against SAVERIO MASSETTJ, of the White Swan Hotel, Christchurch, by reason of the infringement by him of the words “Penfolds” and “Pen fulds” and for passing off wine as that of the Company’s which was not the Company’s wine. The Company had issued a writ against Saverio Massetti and the action was settled by Saverio Massetti consenting to judgment. The Orders of the Supreme Court were to the following effect:— 1. THAT Saverio Massetti, his servants and agents be restrained from using in any way the word “Penfolds” or any colourable Imitation thereof on any container of Wines or Spirits not containing Wines or Spirits of the Company’s growth or manufacture, and from selling or offering or exnosing for sale or passing off as “Penfolds” any Wines or Spirits not of the Company’s growth or manufacture; and also that a Writ of Injunction be Issued accordingly. v 2. THAT Saverio Massetti deliver to the Company on oath within seven days all labels in his possession or under his control which offend against the injunction, and also all “Blocks” and “Stereos” used in connection with the printing or production of such labels. 3. THAT Saverio Massetti deliver to the Company on oath within seven days all bottles or other containers in his possession or under his control bearing labels which offend against the injunction. (• THAT Saverio Massetti publish In Christchurch twice in each of the morning newspapers and once in each of the evening newspapers a Notice together with a copy of the Judgment, in such form as shall be agreed upon between Counsel for both parties, the dattes of publication to be selected by the Company. 5.
