Summing up, his Honor said that the evidence showed two causes that would have resulted in bankruptcy, apart from any extravagant living. There were the losses from the farm. Extravagance in living did not mean speculation, as for instance in connection with the farm, or even carrying on business in a c-areless manner. The charge applied only to extravagance of living, and if there was such, whether it brought about the bankruptcy. With regard to the debt owing to Hurdley and Sons, there was no evidence to show that Carney ordered or sanctioned the purchase. The jury retired at 2.45 p.m.
