DEATH DUTY CASE.
Magistrate Reduces Assessment. (Special to the “ Star.”) OAMARU, August 19. A decision of importance in the present times of depression and falling values was given by Mr H. W. Bundle, S.M., to-day. The Trustees and Executors Agency, as executors of the estate of a deceased person, appealed against a special valuation of £1250 made in pursuance of Section 70 of the Death Duties Act, 1921, for the purpose of assessing death duties. Deceased died on January 4, 1931. Appellants contended that the property should be valued as at that date. The District Valuer, in evidence, stated that special valuations of this nature were made in the same manner as valuations made on a general reviThe Magistrate stated that in his opinion the reasonable valuation based on the selling values as at the date of death was £IOOO. He reduced the valuation accordingly, adding that the valuer’s method of assessing the value did not sufficiently take heed of existing conditions.
