SUPREME COURT ACTION AGAINST TRADING FIRM.

(Special to the “ Star.”) DUNEDIN, November 26. Q.D., Ltd., and H.P., Ltd., again figured as defendant in the > Supreme Court to-day. Daniel Moir sought an order attaching moneys payable to Quarterly Dividends Ltd. and secured by mortgages to that concern in order to satisfy his judgment debt of £548 14s 6d which was the subject of an undefended action in the Supreme Court at Dunedin in August. The defence was that the moneys were not moneys owned by Q.D., Ltd., in its own right, but were trust moneys held for the benefit of depositors in the Q.D depositors’ reserve fund. A further defence was that Q.D. Ltd. had been put into liquidation by an order of the Court in England on August 1, 1930, judgment in Alois's favour having been obtained on August 11. 1930. Air IT. Brasch appeared in support of the motion which was opposed by Air H. E. Barrowclough and Air J.-M. Patterson on behalf of three mortgagors to the reserve fund. After hearing legal argument, his Honor intimated that he would take time to consider his decision.
