SHIPPING COMPANY IS ORDERED TO PAY FOR DAMAGED GLASS.
A claim for £lO 7 10s damages by Andrew Lees, Ltd. against the New Zealand Railway Department was heard in the Magistrate’s Court this morning before Mr H. A. Young, S.M. The New Zealand Shipping Company were joined as defendants on the application of the Department. The claim w'as for damage to a case of glass landed last April from the steamer Rangitiki at Lyttelton. Mr A. W. Brown appeared for the Railway Department and Mr C. G. Penlington for the plaintiff and also for the Shipping Company. The damage w r as admitted, but the Court was asked to decide which of the parties was responsible. For the New Zealand Shipping Company it w’as maintained that during the landing of the cargo at the port the truck in which the case was standing was moved, causing the case to fall, this accounting for .the damage. The Railway Department alleged that after the case had been loaded into the truck another .sling of cargo was swung over and knocked the case out of the truck. The Magistrate said that the circumstances appeared to favour the Railway Department. Judgment would be given against the Shipping Company.
