ORDER IS MADE TO CARRY ON UNDER PARTNERSHIP.

Under an originating summons, in the Supreme Court to-day, before Mr Justice Adams, an interpretation was sought of the will of Christopher Atkinson, of Christchurch, merchant, who died in June last. At the time of his death he was a partner with the trustees of the late Mr Walter Hill in a station property. By his will he authorised his trustee to postpone conversion of his property, and to carry on any business carried on by him at the date of his death. The question for consideration of the Court was whether these directions were sufficiently wide to empower the trustee to carry on the station property partnership. It was submitted that they were sufficiently wide. If the Court held that they were not, the trustee asked the Court to make an order authorising the trustee to continue the partnership formed with Mr Walter Hill for two years, to enable the property to be realised to reasonable advantage. An order was made authorising the trustee to carry on the partnership until a sale can’ be made at a reasonable price. Mr Hunter appeared for the trustee, William Williamson, of Christchurch, merchant, and Mr F. S. Wilding for defendants, Isabella Atkinson, widow of the testator, and his children. The widow and the children concurred in the application.
