CODICIL OF WILL IS IN DISPUTE.

PARTIES NOW SEEK COURT INTERPRETATION. Interpretation of the first codicil to the will of the late Joseph Armstrong, Akaroa, sheepfarmer, was sought today in the Supreme Court. Plaintiffs were Frank Gray Armstrong, Akaroa, sheep farmer, and James Hugh Williams, Christchurch, solicitor. Defendants were Florence May Armstrong, Christchurch, widow, and her children, Minnie Armstrong, Foxton, widow, Lync.h Dignan, Christchurch, Roman Catholic priest, John Dignan. Kent, England, William Lincoln Armstrong, Adavale, Queensland, farmer, George Armstrong. Akaroa, retired farmer; six children of the late James Leslie Armstrong, and Albert Vernon Smith, Christchurch, clerk. Mr Holmes appeared for the trustees, Mr Donnelly for the widow' of the testator's brother, John Armstrong, and for the infant children, and Mr Cuthbert for George Armstrong, representing all the othc defendants. Mr Holmes said that the testator died at Akaroa in October, 1923. His estate was sworn at £42.000, but the present value of the residuary estate had been greatly reduced. The argument was in respect to a mortgage on a Burwood property’. The question was whether it was part of the residuary estate, or whether the income should go to the widow. Judgment was reserved.
