A constable stated that at 7.35 on the evening of June 14 he saw accused approach a girl in the street, grasp her by the throat, and throw her on the pavement. He arrested Kennedy, who said, “ It’s all right. I am subject to fits and feel like assaulting somebody so I’ll give it a fly now.” He stated that he would strip the girl and then strip himself. Kennedy in evidence, said that he mistook the complainant for another girl. lie put his arm around her but did not grasp her by the throat or knock her down. Mr Poynton, S.M., imposed a sentence of two months’ imprisonment.
